Capsicum Group's Leeza Garber, Esq. and Frank Kolarevic presented to a large lunchtime crowd at Carter Ledyard & Milburn regarding forensics and social media. Digital Forensics came about nearly 20 years ago when it became obvious that society was moving into a digital age. Since that time the field has greatly matured with evolving technology. With the advent of laptops, smart phones, the Internet, dense storage systems, on-board chipsets, GPS and much more, Digital Forensics has needed to re-invent its tools and techniques to remain on the cutting edge of technological advances. Social Media, the data it contains and the communications it allows is a no less challenging field. We will provide an overview of what data is available (both active and deleted), how data is accessed and preserved in a forensically-sound manner, and what legal professionals should understand in presenting such evidence in court. This session will also review the major social media technologies utilized today, (i.e. Twitter, Facebook, LinkedIn, YouTube, Pinterest, Blogs, etc.), the risks they present (i.e. legal including defamation, fraud, and theft, social, physical, etc.), and how they can best be preserved and used in court as evidence.
